Refund/Cancellation Policy
CANCELLATION OF CONTRACT The buyer may cancel this contract under the following provisions by notifying the health club of cancellation in writing, by CERTIFIED MAIL RETURN\ RECEIPT REQUESTED, or by personal delivery to the address specified in the health club contract. Upon receipt of notice of cancellation under this paragraph, the health club shall refund to the buyer all monies (minus processing fees) paid in excess of an amount computed by dividing the full contract price, including any initiation fee, by the number of weeks in the contract term and multiplying the result by the number of weeks elapsed in the contract term.
(a) The buyer or his legal representative may cancel this contract if the buyer dies or becomes permanently disabled. In the case permanent disability, the health club will require the buyer to submit a statement from the buyer's attending physician to confirm the nature of the disability. The buyer is required to report any such disabilities to the Club or its agent where the buyer has a disability that precludes the buyer from using the health club facilities for a period of more than six months and the disability is verified by a physician. A cancellation fee of $50.00 IS required to cancel a membership under this provision, as well as proof of disability.
(b) This contract may be canceled if the buyer moves more than 15 additional miles from the health club and is unable to transfer the membership to a comparable facility within five (5) miles of this new residence. A cancellation fee of $50.00 IS required to cancel a membership under this provision, as well as proof of relocation.
(c) If the health club facility closes for a period of more than 30 days, and the health club fails to provide a comparable facility within ten miles of the location designated in the health club contract, the buyer is entitled to cancellation of the contract.
The cancellation of any Annual EFT membership which does not fall under any of the provisions (a, b, or c) will be subject to a fee which is equal to one half (1/2) the remaining contract balance.
Any refunds due the member will be refunded within 40 days of cancellation. Automatic payment/credit card authorization will be terminated within 40 days of cancellation.
*In the state of Pennsylvania, any membership contract can be terminated within three (3) days of purchase for any reason and the purchaser is entitled to a full refund minus any processing fees incurred by Train Yard Gym & Fitness.
